MORENO VALLEY: Deputy sued in fatal shooting case
A Riverside County sheriff's deputy is being sued in federal court over a fatal shooting two years ago in Moreno Valley, court documents show.
Deputy Gary Dean Colbert is accused of fatally shooting 18-year-old Ontario resident Lamon Khiry Haslip in the back while Haslip was handcuffed and lying face-down on the ground at Fir Avenue and Ninebark Street on Dec. 28, 2012.
Filed Monday, Dec. 1, on behalf of Haslip's father -- Orange County resident Tommy Haslip Sr. -- the lawsuit charges Colbert with unreasonable use of deadly force and civil rights violations.
"...Haslip made no aggressive movements, no furtive gestures, and no physical movements which would suggest to a reasonable sheriff's deputy that (Haslip) had the will or the ability to inflict substantial bodily harm against any individual," according to the lawsuit.
A similar lawsuit was filed against Colbert by Haslip's mother -- Jewell Allen of New York City -- on Oct. 2, 2013.
The lawsuit says Haslip had been standing or walking around the intersection before the shooting, but doesn't mention the reason for the confrontation between him and Colbert.
Sheriff's officials don't comment on pending litigation.
However, sheriff's officials said soon after the shooting that the confrontation happened after Haslip fled in a vehicle that deputies attempted to stop. A deputy caught Haslip, held him on the ground and handcuffed him, officials said.
The gunfire erupted after Haslip rolled onto his side with a gun in his possession, said the sheriff's officials.
